Agreement to Terms

These Terms and Conditions ("Terms") govern your use of vundercall's AI-powered call handling service ("Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

Description of Service

vundercall provides an AI-powered call handling system that uses conversational AI technology to manage incoming calls for businesses. Our Service includes:

  • Cloud-based and local-first call routing
  • AI voice agent interaction
  • Call recording and transcription
  • Integration with ElevenLabs conversational AI
  • Call analytics and reporting

Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our Service. By using the Service, you represent and warrant that you meet these requirements.

Onboarding and Account Setup

Access to our Service is provided through a guided onboarding process managed by our team. We will work with you to configure your account and integrate the Service with your business infrastructure. You agree to:

  • Provide accurate, current, and complete information during onboarding
  • Cooperate with our team during setup and configuration
  • Keep your account credentials secure and confidential
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

Acceptable Use Policy

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful, fraudulent, or illegal content
  • Harass, abuse, or harm others
  • Impersonate any person or entity
  • Interfere with or disrupt the Service
  • Attempt unauthorized access to our systems
  • Use the Service for telemarketing without proper consent
  • Record calls without appropriate legal notification

Call Recording and Consent

You are responsible for ensuring compliance with all applicable laws regarding call recording and consent in your jurisdiction. In the UK, this includes the Regulation of Investigatory Powers Act 2000 (RIPA) and UK GDPR. You must:

  • Obtain necessary consent from call participants
  • Provide appropriate notification of recording
  • Comply with data protection regulations
  • Use recordings only for lawful purposes

Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted access to the Service. We may:

  • Perform scheduled maintenance with advance notice
  • Suspend the Service for emergency repairs
  • Modify or discontinue features with reasonable notice
  • Implement usage limits to ensure fair use

Pricing and Payment

Pricing for our Service is as published on our website. You agree to:

  • Pay all fees according to your chosen plan
  • Provide valid payment information
  • Pay on time (monthly or annually as selected)
  • Accept responsibility for all charges on your account

We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing period.

Subscription and Cancellation

Subscription Terms:

  • Subscriptions renew automatically unless cancelled
  • You may cancel at any time before the next billing cycle
  • Cancellation takes effect at the end of the current period
  • No refunds for partial months or unused portions

Intellectual Property

All content, features, and functionality of the Service are owned by vundercall or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or create derivative works
  • Reverse engineer or decompile the Service
  • Remove proprietary notices or labels
  • Use our trademarks without permission

Your Content

You retain ownership of call recordings and data you create using the Service. By using the Service, you grant us a limited license to:

  • Store and process your data to provide the Service
  • Use aggregated, anonymized data to improve AI models
  • Share data with service providers (e.g., ElevenLabs) as necessary

Third-Party Services

Our Service integrates with third-party providers, including ElevenLabs for conversational AI. Your use of these integrated services is subject to their respective terms and privacy policies. We are not responsible for third-party services or their content.

Limitation of Liability

To the maximum extent permitted by law, vundercall shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Service interruptions or data loss
  • Actions of third parties or unauthorized access

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless vundercall from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any laws or third-party rights
  • Your content or call recordings

Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted or error-free
  • AI transcriptions will be 100% accurate
  • The Service will meet your specific requirements
  • Security measures will prevent all unauthorized access

Termination

We may suspend or terminate your access to the Service:

  • For violation of these Terms
  • For non-payment of fees
  • For illegal or fraudulent activity
  • At our discretion with 30 days' notice

Upon termination, your right to use the Service ceases immediately. We will provide access to your data for 30 days following termination.

Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use after changes constitutes acceptance.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and vundercall regarding the Service.
